Lasting powers of attorney

Background

  • Susan had experienced at first hand the problems that illness and mental incapacity can cause loved ones.

  • Following a massive stroke, her father Brian had subsequently been left in a coma and she was appointed by the Court of Protection as her father's deputy -  this meant her powers and responsibilities were subject to overall control by the Court of Protection.

     

Challenges & Concerns

  • Unfortunately Susan’s father had not appointed any attorneys meaning that his financial and property and social welfare affairs were controlled by the Court of Protection and NOT his wife or daughter.

     

What We Did

  • Acting on behalf of Susan & her mother we arranged both types of Lasting Power of Attorney for both of them (they both appointed each other plus Susan’s husband as their respective attorneys).

  • Sadly nothing could be changed regarding Brian’s affairs as he no longer has capacity

  • All powers have been registered with the Office of the Public Guardian

     

The Results

  • Immediate peace of mind for all the family

  • Both Susan & her mother now have their affairs looked after by close family members & not faceless bureaucrats.
